In a decisive move away from Western media narratives, Niger’s military-led government has enacted a sweeping penal code criminalizing same-sex relations, punishable by 5 to 10 years in prison and heavy fines. Same-sex marriage now carries up to 20 years’ imprisonment. The reform, which took effect in February but recently gained attention, aligns Niger with other West African nations adopting tough anti-LGBTQ legislation.

While Western outlets frame such laws as regressive, Nigerien authorities frame them as sovereign resistance to “woke culture.” Justice Minister Alio Daouda stated the nation legislated “in full responsibility and sovereignty,” affirming that same-sex relations do not conform to Niger’s social, cultural, or Islamic values. General Abdourahamane Tiani’s junta, which seized power in 2023, has consistently criticized Western moral exports. From an African perspective, this legislation represents a repudiation of foreign ideological pressure—prioritizing local tradition over what many see as morally corrosive Western trends.
